Job Summary

General Counsel provides legal advice to the President/Chief Executive Officer, senior management, and the Board of Directors and responsible for management and oversight of legal affairs at the Health System.  Oversees Enterprise Risk Management, Insurance, Governance, and Accreditation and Regulatory and Environment of Care functions.

Job Specific Duties

  • Oversees legal and administrative functions related to Enterprise Risk and Claims management to ensure that policies and procedures are in place to effectively address liability claims and risk prevention; actively manages claims.
  • Provides counsel to the President/Chief Executive Officer and to the Chairman of the Board regarding matters related to the Board of Directors and staff meetings of the Board and/or Board Committees as requested. 
  • Provides legal advice to Health System personnel, medical staff members, and the Bioethics Committee on issues related to bioethics and consent for treatment of minors. 
  • Provides legal counsel to the Chief Medical Officer, Senior Vice President for Medical Affairs concerning the medical staff, including credentialing and privileges, bylaws, licensure, and other matters governed by state and federal legislation.
  • Retains, manages, and directs outside counsel in collaboration with senior management to ensure competent and cost effective representation of the Health System in legal matters. 
  • Manages the Contract Management function for the System and its affiliates; reviews and provides legal counsel regarding contracts, as requested. 
  • Oversees Accreditation and Regulatory Department for regulatory effectiveness for NCHS. 
  • Oversees Environment of Care for the System. 
  • Oversees Governance for the System and provides support for the CEO, Board of Directors and supports and staffs all Board and committee meetings; serves as the Principle for the Governance Committee. 
  • Provides legal counsel for all affiliate organizations for the System.
  • Oversees all insurance for the System and its affiliates, including purchasing re-insurance for the System’s Captive Insurance Program which includes professional and general liability, property, cyber, special events, etc.
  • Collaborates with the Compliance Department and provides legal counsel on all compliance related matters. 
  • Supports the Privacy Officer and provides legal counsel for all privacy related matters. 
  • Supports Strategy and provides legal counsel on structuring all affiliations and relationships with the System and its affiliates. 
  • Supports TM&E with legal advice on all employment related issues. 
  • Provides legal guidance and advice on all government affairs matters. 
  • Oversees all litigation by/against the System and any affiliates. 
  • Provides legal counsel for all research matters.
  • Oversees inhouse subject matter expertise in the following areas: managed care, employment, research, compliance, privacy, telemedicine, real estate, intellectual property, and physician contracting. 
  • Managing third party subpoenas and garnishments. 
  • Providing legal advice regarding NCH teaching program. 
  • Providing legal advice to the Foundation regarding donor-related issues. 
  • Providing legal advice and support on all real estate, construction matters, and IT issues. 
  • Providing legal advice and support for Corporate Communications. 
  • Providing legal advice and support on all physician contracts and relationships. 

Qualifications

Minimum Job Requirements

  • Juris Doctorate Law Degree from an accredited US Law School
  • Attorney Licensed to practice law by the Florida Bar
  • Board Certified in Health Law by the Florida Bar
  • More than 10 years of legal experience in Healthcare field

  • Ability to interpret, adapt, and react calmly under stressful conditions.
  • Ability to use complex mathematical techniques to budget and provide productivity assessments.
  • Ability to use logical and scientific thinking to interpret technical data and solve a broad range of problems.
  • Able to relate cooperatively and constructively with clients and co-workers.
  • Effectively monitor and develop the abilities of subordinates.
